A regulation was made to grant music broadcasting permission to workplaces and marine vessels that broadcast music within the scope of the “Environmental Noise Control Regulation” prepared by the Ministry of Environment, Urbanization and Climate Change and published in the Official Gazette dated 30 November 2022. By arrangement; The procedures and principles regarding the works and transactions regarding the Music Broadcasting Permit have been redefined. Again with the same regulation, outdoor activities; A “Music Broadcasting Permit” will be obtained from the Provincial Directorate of Environment, Urbanization and Climate Change in organizations that can be held for a maximum of 10.00 consecutive days between 01.00-5 and will continue for more than 5 days, in a way that the limit values ​​for music broadcasting establishments will be met.

Within the scope of the “Environmental Noise Control Regulation” published in the Official Gazette dated 30 November 2022 by the Ministry of Environment, Urbanization and Climate Change, practices regarding the control and management of environmental noise were determined.

Accordingly, arrangements were made to grant music broadcasting permissions to music broadcasting establishments and marine vessels, and the procedures and principles for the works and procedures related to the Music Broadcasting Permit Certificate were prepared.

The details of the "Environmental Noise Control Regulation" in the Ministry's statement are listed as follows:

Within the scope of music broadcasting workplaces and marine vehicles;

For businesses and marine vehicles that broadcast music; Information such as business and working license, if any, tourism operation certificate, tax plate samples, circular of signature or power of attorney and acoustic report, and music broadcasting permit application petition will be submitted to the Provincial Directorate.

In addition, the undertaking prepared that the provisions of the Environmental Noise Legislation will be complied with and that additional noise control measures will be taken if necessary must be submitted to the Provincial Directorate.

It has been stipulated that a copy of the acoustic report prepared in printed and electronic media by companies that have received a qualification certificate from the Ministry should be kept in workplaces and sea vehicles to be submitted during inspections and uploaded to the web application determined by the Ministry.

In addition, the information and documents presented; When necessary, it will be evaluated by the provincial directorate, accompanied by examination and evaluation studies in the field.

“Permission for music broadcasts will be given by the Provincial Directorate”

Regarding the permission of music broadcasts; If the report is found appropriate, the applicant must be notified of the eligibility, the Music Broadcasting Permit fee must be deposited into the revolving fund account and a "Music Broadcasting Permit" must be issued by the Provincial Directorate.

If it is not found appropriate, it is stated that the application file can be returned to the applicant with its justification and the application can be made again after the nonconformities specified in the reasoning are eliminated.

“The validity period of the Music Broadcasting Permit is 3 years”

The validity period of the Music Broadcasting Permit was determined as 3 years. At least 6 months before the expiry of this period, an application must be made for the renewal of the music broadcasting permit.

Music not subject to release; workplaces such as hairdressers, markets, coffee shops, gyms and patisseries will be able to continue their activities without creating environmental noise. In the event that the provisions of the regulation are found to be violated 3 times in the same calendar year, the music broadcasting permission will be canceled by the Provincial Directorate, and these workplaces and marine vessels will only be able to apply for music broadcasting permission after 2 calendar years.

It has been determined how environmental noise measurement methods will be applied regarding the level of noise originating from music broadcasting workplaces and radiated by air or transmitted to uses through common partition elements, intermediate floors, ceiling or adjacent walls.

“For activities exceeding 5 days, activities can be continued by obtaining a Music Broadcasting Permit from the Provincial Directorate of Environment, Urbanization and Climate Change”

Outdoor activities such as concerts and festivals held in the open air for a temporary and limited time; A “Music Broadcasting Permit” will be obtained from the Provincial Directorate of Environment, Urbanization and Climate Change in organizations that can be held for a maximum of 10.00 consecutive days between 01.00-5 and will continue for more than 5 days, in a way that will meet the limit values ​​for music broadcasting establishments.

For such events; Administrative and technical issues have been determined regarding the determination of the maximum number of activities per year and the strategic noise maps for the areas where these activities are allowed, in a way that will not be the subject of a complaint in the Provincial Environment Board.
