Court cannot be exempt from Gulf Crossing Bridge EIA

The Court cannot be exempt from the EIA of the Bay Crossing Bridge: The court has decided that the Gulf Crossing Bridge project, which is the most important part of the Gebze-Orhangazi-İzmir Highway Project and will reduce the distance between Istanbul and Izmir to 3,5 hours, cannot be exempt from EIA.

As a result of the lawsuit filed by Erol Çiçek, one of the lawyers of the Environment and Ecology Movement (ÇEHAV), operating in Bursa, the court decided that the Gebze-Orhangazi-İzmir Motorway and the İzmit Gulf Crossing Project could not be exempt from the EIA report. Plaintiff Erol Cicek wanted the implementation of the court decision, the construction should be stopped and 30 within the day of the EIA process should be started, he said. Erol Cicek applied to the Ministry of Environment and Urbanization through the Prime Ministry Communication Center (BIMER) requesting the initiation of the EIA process of the Gebze-Orhangazi-Izmir Motorway and Izmit Gulf Crossing Project with a petition in 7 July 2014.

The Ministry's Environmental Impact Assessment, Permit and Inspection General Directorate rejected the application on 22 July 2014 on the grounds that 'Gebze-Orhangazi-İzmir Highway and İzmit Bay Crossing Project are exempt from the EIA process'. Thereupon, lawyer Çiçek brought the situation to the judiciary.

Ankara 12th Administrative Court, by evaluating the process, relevant Constitutional regulations, international texts, changes in laws and regulations, the Constitutional Court (AYM), the Council of State decisions and the ECHR case law, in particular, taking into account the binding principle of the Constitutional Court decisions, 'no longer exemption "There is no legal compliance in the process regarding the rejection of the plaintiff's request to initiate the EIA process for the Gebze-Orhangazi-Izmir Highway and Izmit Bay Crossing Project, which could not be considered within the scope of the project."

The court unanimously decided to cancel the ministry's transaction. The parties will be able to appeal the decision to the Council of State within 30 days following the notification of the decision.

Lawyer Çiçek, upon the notification of the court decision, by applying to the ministry, Gebze-Orhangazi-Izmir Highway and Izmit Gulf Crossing Project to stop the construction activities and EIA process to be initiated, the court decided to implement the decision.

PLANNED TO OPEN IN MARCH 2016

The most important part of the Gebze-Orhangazi-Izmir Motorway Project, which will enable the Istanbul-Izmir to land at 3,5 hour, will be opened at March 2016.
